Welcome to www.my-mp.org.uk (the "Website"). The Website is
owned and operated by Public Zone Limited ("we", "us", "Public
Zone"). These are our terms and conditions for use of the Website
which apply whenever you access the Website, on whatever
device.
You are required to register in order to use the Website. By
completing the initial registration form and by entering your email
address and password, you will be deemed to have accepted these
terms and conditions.
If you have registered with us and subsequently change your
details, you should immediately notify us of any changes by
emailing the user support team at
support@my-mp.org.uk
1. Registration
The Website is available only to members of the UK Parliament
("MPs"). When you register, you are registering as a personal user
of the Website in your capacity as an MP. A Public Zone employee
will independently confirm your details prior to making your App
live.
We allow you access to the Website on the basis that:
(i) your email address, user ID and password are personal to you
and your team and may not be used by anyone else to access the
Website;
(ii) you will not do anything which would assist anyone to
access the Website;
(iii) you do not maliciously create additional registration
accounts for the purpose of abusing the functionality of the
Website, or other users; nor do you seek to pass yourself off as
another user or MP;
(iv) you will assist us in verifying your identity as an MP
prior to granting you access to the Website, including without
limitation, confirming your identity via a telephone call placed to
your official MP telephone number;
(v) you comply with these terms and conditions.
If, for any reason, we believe that you have not complied with
these requirements, we may, at our discretion, cancel your access
to the Website immediately and without giving you any advance
notice.
2. Termination of registration
If we wish to bring the agreement to an end, we will do so by
emailing you at the address you have registered stating that the
agreement has terminated. The agreement will terminate and your
user ID and password will become invalid immediately.
3. Use of material posted by you on the
Website
For the purposes of this agreement, "Materials" means any
material including, without limitation, text, video, graphics and
sound material, posted by you onto the Website.
The Materials will be made available by Public Zone to
subscribers to the MyMP iPhone app ( the "App") by various means of
telecommunication. Public Zone will make reasonable endeavours to
ensure, but cannot guarantee, that all persons subscribing to the
App to follow your posts ("Subscribers") are residents of the
constituency you represent in the UK Parliament.
You hereby grant to Public Zone the non-exclusive, perpetual,
royalty-free and irrevocable worldwide right and licence to use and
to grant to others the right to use, receive, download, adapt
(including the right to edit and combine with other material),
reproduce, distribute, publish, display, broadcast, transmit,
digitise, exploit or otherwise make available the Materials in any
format, including without limitation print and electronic
format.
You hereby warrant that you own the copyright and any other
relevant rights in the Materials and that nothing contained in the
Material shall be obscene, libellous, defamatory or otherwise
unlawful or infringe the rights (including any intellectual
property rights) of any third party. You are and remain liable for
the content of any Materials and hereby agree to indemnify Public
Zone in respect of any loss, damage, cost or expense (including
reasonable legal costs and expenses) incurred by Public Zone as a
result of your breach of any warranty or undertaking under this
Agreement.
You acknowledge that any breach of these warranties may cause us
damage or loss and you agree to indemnify Public Zone in full and
permanently against any third party liabilities, claims, costs,
loss or damage we incur as a result of publishing the Materials,
including consequential losses.
We reserve the right to remove your access to the Website if we
believe you are abusing the service in any way.
You can deactivate your subscription to the Website at any
time. Public Zone will stop making your Materials available
to Subscribers via the App, provided that there may be a time lag
in this termination of service as a consequence of third party
requirements, including those of Apple Computers Inc.
4. Accuracy of Information
Pubic Zone makes no warranties, expressed or implied, as to the
Website or the App (including without limitation as to its/their
accuracy, availability, adequacy, quality or fitness for any
particular purpose) and all such warranties are expressly excluded
to the fullest extent that such warranties may be excluded by law.
You bear all risks from any uses or results of using the Website
and/or the App. You are responsible for validating the integrity of
any information created, received or accessed by you.
5. Use of aggregated data.
The Materials posted by you on the Website will be aggregated
with materials posted by other Website users (together, "Aggregated
Materials"). Copyright and all other intellectual property rights
subsisting in (i) the Aggregated Materials, (ii) the database or
any data extracted from the Aggregated Materials or (iii) in any
piece of information provided through the Aggregated Materials
(together the 'Information') is owned by Public Zone. Public
Zone has the right to publish, copy, disseminate or use the
Aggregated Materials for any purpose, including without limitation
advertising and commercial purposes, without any compensation being
payable to you or another person.
6. Data protection
Public Zone is a limited company incorporated in England and is
registered under the Data Protection Act 1998. All personal
information you supply to us will be treated in accordance with
that Act.
7. Variations
These terms may be varied from time to time. Please ensure that
you review these terms and conditions regularly as you will be
deemed to have accepted a variation if you continue to use the
Website after it has been posted.
8. Force majeure
Although we will do our best to provide constant, uninterrupted
access to the Website, we do not guarantee this. We accept no
responsibility or liability for any interruption or delay.
9. Governing law & jurisdiction
This agreement is governed by English law and the parties agree
to submit to the exclusive jurisdiction of the English courts.
